Scope of this Policy
This Privacy Policy explains how OCTOBER CAPITAL FUNDING LLC ("October Capital Funding," "we," "us," or "our") handles information collected through octobercapitalfunding.com, our contact forms, business financing request forms, document-submission features that we make available, and communications that result from those requests.
This Policy is intended to describe the website and business process that we actually operate. It does not govern the independent privacy practices of a lender, funder, bank, factoring company, financing provider, technology provider, or other third party after you submit information directly to that organization or leave our website. Those third parties may provide their own privacy notices, agreements, and data-handling terms.
Information We Collect
The categories of information we collect depend on how you use the website and which financing path you are exploring. We may collect information that you provide directly, including the following:
- Owner and contact information: first and last name, email address, telephone number, ownership percentage, business title, and owner mailing or residential address used for the financing request.
- Business information: legal business name, DBA, entity type, industry, operating status, business start date, state of formation, business address, business phone, website, and related company information.
- Financing-request information: requested amount, financing preference, intended business use of proceeds, current financing obligations, and other information relevant to a commercial financing request.
- Business and financial profile information: monthly revenue range, business checking-account status, existing business financing, and an applicant-provided estimated personal credit-score range. The estimated credit-score question does not itself obtain or pull a consumer report.
- Documents: the application currently requests four recent complete business bank statements and a voided business check and also allows optional supporting business records such as invoices, accounts receivable information, or business financial statements. A later secure provider process may request other records, including tax documents or government-issued identification.
- Communications and consent records: messages, call or email follow-up information, records of authorizations and acknowledgements, timestamps, policy versions, and application reference numbers.
- Technical information: information generated by normal website and hosting operations, such as IP address, browser type, device information, server logs, security events, and basic request information.
We do not ask applicants to provide online-banking passwords, one-time authentication codes, PINs, or security-question answers through the website.
Sensitive Information and Secure Provider Processes
The standard website application is designed to collect an initial commercial financing request and supporting business documents. It is not intended to collect account-access credentials. Do not submit online-banking usernames or passwords, one-time codes, debit-card PINs, CVV values, or security-question answers.
A financing provider may later require date of birth, Social Security number, tax identification information, government-issued identification, credit authorization, bank verification, or similar underwriting information. When that information is required, October Capital Funding may direct the applicant to a provider-hosted secure application, a provider portal, or another approved secure workflow. If we later operate our own server-side workflow for sensitive identity information, we will update this Policy before using that workflow for live applicants.

Sources of Information
We may receive information directly from the applicant or another person authorized to act for the business. We may also receive information from documents submitted through the website, communications with the business, referral sources, financing providers or commercial finance partners, public business records, and service providers that support verification, fraud prevention, hosting, communications, or compliance.
When a financing provider returns status information, requests additional documents, or communicates the outcome of its review, we may receive and maintain information necessary to coordinate the financing request and related business records.
How We Use Information
We use information for legitimate business purposes connected with the services requested by the applicant. These purposes can include:
- responding to questions and administering a business financing request;
- understanding the business, requested use of funds, timing, and potential financing needs;
- identifying commercial financing categories or providers that may be relevant;
- preparing, organizing, routing, or facilitating a referral or provider application with appropriate authorization;
- communicating about missing information, supporting documents, provider status, or next steps;
- verifying information, authority, and identity where appropriate;
- preventing fraud, abuse, security incidents, unauthorized access, and other misuse;
- maintaining consent, business, compliance, accounting, security, and dispute records;
- operating, troubleshooting, securing, and improving the website and related systems; and
- complying with applicable legal obligations and protecting legal rights, safety, and property.
We do not use application field contents as advertising copy or intentionally place applicant financial information into advertising analytics events.
Application Validation, Fraud Prevention, and Service-Scope Screening
We may use information submitted through the application, together with technical and security signals, to validate fields, reduce spam, detect duplicate or automated submissions, identify potentially fraudulent or abusive activity, and determine whether a request falls within the commercial financing services we currently handle.
Examples of information used for these purposes can include whether the request is for a bona fide business purpose, whether contact information appears usable, whether submitted text appears automated or abusive, the time required to complete the application, document metadata, and other consistency checks. Business profile information such as operating history, revenue range, estimated credit range, or business-checking status may also be used to flag a file for additional review, but those factors are not treated by this website as a provider underwriting decision. We do not publish all anti-fraud thresholds because doing so could make those protections easier to bypass.
Some checks can stop an online submission when the request is clearly outside the scope of the service or appears abusive. Other signals are treated only as review flags and may result in a request for additional information, a different financing path, or manual review. Website screening is not underwriting and does not determine whether a financing provider will approve or decline a transaction.
Financing Providers and Commercial Finance Partners
When you ask us to assist with a business financing request and provide the required authorization, we may disclose information relevant to the request to one or more independent financing providers or commercial finance partners so they can evaluate, verify, process, or respond to the request.
The information shared can include business identity, ownership and contact information, financing needs, revenue and other business financial information, existing obligations, and supporting documents when those items are reasonably necessary for provider review. We try to limit sharing to information relevant to the requested commercial financing process.
Financing providers make independent underwriting and transaction decisions. They may contact the applicant directly, request additional information, conduct verification, or require use of their own secure application. Information submitted directly to a provider is subject to that provider's own privacy practices and agreements.
Service Providers and Form Processing
We may use service providers to support website hosting, form processing, email delivery, cybersecurity, IT administration, document handling, professional services, legal or compliance support, and other business operations. These parties can process information on our behalf or under their own applicable terms and privacy practices.
The current website sends contact inquiries and financing applications through server-side website endpoints hosted with Vercel. Contact messages are delivered to finance@octobercapitalfunding.com through the company's Hostinger Email mailbox using authenticated SMTP.
For the financing application, selected business documents are uploaded individually to a private Vercel Blob store as temporary staging files before the application is delivered. Private Blob objects require authenticated server access and are not intended to be publicly accessible. The application currently accepts PDF, JPG, and PNG files, limits each file to 3.5 MB for the secure server-upload workflow, and limits the combined document set to 10 MB.
After the application and attachments are successfully handed to the receiving Hostinger mailbox, the website is designed to delete the temporary Blob staging copies. If delivery fails, the application attempts cleanup of uploaded staging files. Copies of successfully delivered messages and attachments may remain in the receiving email system and in business records maintained by October Capital Funding.
Legal, Security, and Business Disclosures
We may disclose information when reasonably necessary to comply with applicable law, regulation, subpoena, court order, governmental request, or other legal process. We may also use or disclose information to investigate fraud, security incidents, unauthorized use, disputes, or threats to the rights, property, or safety of October Capital Funding, applicants, providers, or others.
Information may also be transferred in connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, subject to applicable law and the circumstances of the transaction.
Advertising Data and Unrelated Data Brokers
As part of the current website process, we do not disclose completed financing applications to unrelated data brokers for their independent mass-marketing use. Disclosing application information to a financing provider for the commercial financing service requested by the applicant is part of the referral and application process described in this Policy.
Privacy-law definitions of "sale," "sharing," or similar terms can differ by state. We do not make a blanket legal representation that every provider disclosure is outside every statutory definition. If our advertising or data-monetization practices materially change, we will review the applicable requirements and update this Policy before implementing the new practice where required.
Data Retention
We retain information for as long as reasonably necessary for the purposes for which it was collected, including processing and following up on the financing request, maintaining business and consent records, supporting provider relationships, preventing fraud, investigating security issues, resolving disputes, satisfying contractual obligations, and complying with legal or regulatory requirements.
Retention periods can differ by record type. A financing request that results in a provider referral may need to be retained differently from an abandoned contact inquiry. Temporary application documents are staged in private Vercel Blob storage only for the delivery workflow and the website is designed to remove those staging copies after successful email delivery. Copies delivered to the October Capital Funding email system may remain subject to our own business-record retention and deletion practices, and service providers may maintain limited operational or security records under their own policies.
When information is no longer reasonably needed, we may delete, destroy, de-identify, or otherwise dispose of it consistent with applicable obligations and practical system limitations.
Information Security
We use reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. Depending on the system, these measures can include access controls, secure configuration, multi-factor authentication, software maintenance, vendor review, device security, document-handling procedures, and incident-response practices.
Florida law and other applicable requirements can impose obligations concerning the protection of electronic personal information and response to certain security incidents. We evaluate security incidents based on the information involved, the affected systems, applicable law, and the circumstances of the event.
No method of electronic transmission, email delivery, or data storage can be guaranteed to be completely secure. Applicants should use only verified links and should contact us if they suspect that an application communication is fraudulent.
Communications and Marketing Choices
We may use the email address and telephone number provided by the applicant to communicate about the financing request, missing information, documents, provider follow-up, status, or other service-related matters. These communications are part of responding to the request submitted by the business.
A standard website financing request does not by itself enroll the applicant in an unrelated automated marketing-text program. If we later offer marketing text messages, prerecorded promotional calls, or similar communications that require separate consent, the required consent will be presented separately and will not be pre-checked.
You may contact us to update communication preferences. Some service or transaction-related communications may still be necessary while a request is active.
Privacy Requests and State Rights
You may contact us to ask what information we maintain in connection with a website request, request correction of inaccurate information, request deletion where appropriate, or update communication preferences. We may need to verify your identity and authority to act for the business before responding.
Depending on your state of residence, the nature of the information, and whether a particular state privacy law applies to October Capital Funding, you may have additional rights concerning personal information. The website may link to financing providers, government resources, document portals, or other third-party sites. We do not control the security, content, availability, or privacy practices of those sites. Review the applicable third party's privacy notice and terms before submitting information directly to it.
When we provide a link to a secure provider application, confirm that the destination is the intended provider or authorized service before entering sensitive information.
Changes to this Policy
We may update this Privacy Policy to reflect changes in law, technology, website features, service providers, financing-provider relationships, document workflows, or business practices. The revised Policy will display a new effective or last-updated date. When required by applicable law, we will provide additional notice of material changes.
